Lease laws
Many regulations govern leasehold properties. We've listed a brief outline below:
Landlord and Tenant Act 1985 (as amended) sections 18-22
- Section 18 defines what a service charge is
- Section 19 discusses the reasonableness of charges. This includes both the cost and the quality of the work
- Section 20 says we must consult you on major repairs and improvements. It also covers the invoicing timescales for works and more
- Section 21 requires us to give you a regular statement of account, in a specific format. It also states when to withhold a service charge. It lists the documents to include with any payment demand
- Section 22 sets out your right to inspect the documents used to calculate your service charge
Commonhold and Leasehold Reform Act 2002, sections 71-178
- Sections 71-113 set out the details of the right to manage
- Sections 114-128 detail leasehold enfranchisement. It is when leaseholders buy the freehold from their landlord
- Sections 129-136 set out the right to renew your lease
- Sections 137-149 discuss leasehold houses. They are not relevant to our housing stock
- Sections 150 - 155 update and improve the rights given to you under the Landlord and Tenant Act 1985 (as amended)
- Sections 167-172 set out the rules for the forfeiture of lease
