Health and Safety (Traded Service) Privacy Notice

Who are we and what we do 

The Health and Safety Team is part of Gateshead Council. We are based at the Civic Centre, Gateshead. We provide the following services to organisations that purchase our SLA:  

  • professional health and safety advice and guidance.  This includes provision of a named Health and Safety Officer to support your establishment. 
  • liaison with enforcement authorities (for example, Health and Safety Executive (HSE)) 
  • guidance on health and safety legislation, best practice and policies and procedures 
  • provision of advice and support on conducting risk assessments 
  • provision of an incident reporting system and the administration of it
  • investigate accidents and incidents as deemed appropriate.  This includes reporting to the Health and Safety Executive under the Reporting of Incidents, Diseases and Dangerous Occurrences Regulations (RIDDOR) 
  • site visits to investigate problems and discuss complex issues 
  • practical support in dealing with external agencies such as Trade Unions, and health and safety executive 
  • provision of safety alerts and safety briefings to assist the school or academy to meet their responsibilities 
  • consultation with schools, academies and trade unions via the School's health and safety advisory group 
  • Access to CLEAPSS (Consortium of Local Education Authorities for the Provision of Science Services). This includes access to the CLEAPSS telephone and email helpline and resources on the CLEAPSS website. 
  • Radiation Protection Officer (if applicable) 

What type of information is collected about you  

We collect personal information to understand your needs and provide services to our client organisation. Information may include: 

  • name  
  • address 
  • date of birth 
  • email address and telephone number 
  • gender 
  • details of your qualifications and skills 
  • information about medical or health conditions 

How we collect information about you  

We collect information about you from various sources to ensure that we meet your needs, including any information that has been: 

  • recorded or processed in accordance with procedures relating to accidents, near-misses or incident investigations relating to an educational visit. This can include names, addresses, phone numbers health information, details of any witnesses or third parties 
  • recorded or processed as part of audits and inspections 
  • received via emails, phone calls and forms 

Why we need your information  

Our purpose for collecting personal information is to enable us to:  

  • perform the services listed above and with accurate and up-to-date information

The lawful basis for our processing is: 

  • legal obligation  
  • legitimate interests 

Our lawful basis for processing of sensitive personal data is:   

  • reasons of substantial public interest (with a basis in law) 

The legislation the service is obliged to comply with includes: 

  • The Health and Safety at Work Act 
  • reporting of Incidents, Diseases and dangerous Occurrences Regulations (RIDDOR). 

Who your information can be shared with  

Our Corporate Privacy notice explains information sharing the Council carries out. This sharing fulfils statutory obligations, legal requirements and service delivery. The Health and Safety Team can share your information with:  

  • internal staff as appropriate for example line management

  • Trade Unions 

  • insurance representatives 

  • the health and safety executive 

  • the emergency services 

If we wish to share your information with other council services or third parties for purposes outside of those listed above, we will ask your permission.  

How long we will keep your information

We keep your information for as long as we need to provide services to you. We may also need to keep your information in accordance with legal or other obligations. Where we have no need to keep your data it will be securely destroyed. We keep a Record of Processing Activity (a requirement under the GDPR).
