Right of First Refusal

If you have bought your property through Right to Buy and it is less than 10 years since your sale date, you must offer your home back to Gateshead Council.

The Housing Growth and Development team will decide if we will buy your property. If not, you will get a document confirming you can sell it on the open market. Please keep this with you as your solicitors will need this for any sales in the future.

If you bought your property on the open market, you do not need to repay the discount or offer it back to Gateshead Council. This applies if you did not buy it through Right to Buy.

Repayment of discount

You can sell your home any time after you've bought it. However, if you bought it as a tenant under the Right to Buy scheme, and you sell within five years, you may have to repay some or all of the discount.

This is a percentage of the price for which you are selling your property.

There are exceptions to repaying the discount. For example, if the property is compulsorily purchased or transferred to you in a divorce.
