Gateshead network of children with disabilities

This privacy notice tells you about what information we collect about you, how we  use that information and who we share it with.  

Who are we and what do we do 

Gateshead Council is required to keep a register of children and young people with a special educational need or disability up to the age of 25. In Gateshead  we call this register the Gateshead network of children with disabilities.  

This privacy notice provides specific information about how we process your personal data. It is an addition to the information contained in our Corporate Privacy Notice.  

What type of information is collected about you  

We collect personal information to understand your needs and provide services. Information may include: 

  • child name, address, date of birth  
  • parent/carer name, address and contact details  

We also collect the following special category data: 

  • gender 
  • type of disability, for example mobility, learning difficulty, communication problems 
  • details of any specific condition, for example autism, downs syndrome 

 

How we collect information about you  

We collect information about you from various sources to ensure that we meet your needs, including: 

  • information will normally be collected through an on line application form
  • if requested information can be gathered via email if applicant unable to use on line application

 

Why we need your information  

Our purpose for collecting personal information is to enable us to:

  • provide services to you. It is necessary for us to use your personal information to assess your needs and identify the most appropriate services available to you.

To do so we will use the following lawful basis for processing your information: 

  • the data subject has given consent to the processing of his or her personal  data for one or more specific purposes
  • processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller 

Where more sensitive data is involved such as health records, (referred to as "Special Category" data) then an additional basis is required to  process this data. For special category data we rely on the following: 

  • the data subject has given explicit consent to the processing of those personal data for one or more specified purposes 
    • health or social care (with a basis in law)  
    • reasons of substantial public interest (with a basis in law)

The legislation the service is obliged to comply with includes: 

  • all Councils have a legal obligation to maintain a register under the Children's Act 1989.

Who your information can be shared with  

The information we collect will be used to enter your child's details onto the Gateshead network of children with disabilities to enable information of interest to be shared with you as follows:  

  • letter, email or text alerts will be provided with information about services and events that may   be of interest to parents and carers of children who have a disability and/or learning disability
  • entry into Max Card scheme which offers discounts to organisations across Gateshead and the North East
  • you will also have the option of sharing your contact details with the Gateshead Parent Carer Forum which organises events for parents and carers

Statistical information may also be used to help us to understand better what services are needed and in what areas. This information will be anonymised so that individuals cannot be identified.  

Who your information can be shared with 

Our Corporate Privacy notice explains information sharing the Council carries out. This sharing fulfils statutory obligations, legal requirements and service delivery. 

If we wish to share your information with other council services or third parties for purposes outside of those listed above we will ask your permission.

How long we will keep your information  

We keep your information for as long as we need to provide services to you. We may also need to keep your information in accordance with legal or other obligations. Where we have no need to keep your data it will be securely destroyed. We keep a Record of Processing Activity (a requirement under the GDPR). We hold personal information in secure electronic systems on Gateshead council servers.

Our delivery of efficient services depends on the accuracy of your information.
